This website is operated by Little Pot of Gold Limited. Throughout the site, the terms “we”, “us” and “our” refer to Little Pot of Gold. Little Pot of Gold offers this website, including all information, products and services available from this website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our website and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”). These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants and/or contributors of content.

LITTLE POT OF GOLD LIMITED: TERMS OF SERVICE
These terms and conditions of trade apply to all our sales. Any order placed with Little Pot of Gold Limited (“Our”, “Us”, “We”) by you (“You” or “Customer”) constitutes your agreement to be bound by these terms.
1. SALES AND PURCHASE
1.1 Your placement of an order with us (“Order”) constitutes an offer by you to purchase goods from us on these terms. The Order is placed when it is submitted to us.
1.2 Unless other wise agreed in writing with us, you must not purchase goods from us for the purpose of resale.
1.3 If we accept the Order, a binding contract between you and us will arise on these terms (the Contract).
2. PRICING
2.1 Prices quoted on our website include GST.
2.2 Delivery costs will be added to the Cart upon payment.
2.3 Unless otherwise agreed in writing, the price of the goods will be the current price on the day of order. We may change our prices from time to time.
2.4 The prices we charge must be paid before we have an obligation to deliver.
3. PAYMENT
3.1 Prices quoted on our website include GST.
3.2 Delivery costs will be added to the Cart upon payment.
3.3 Unless otherwise agreed in writing, the price of the goods will be the current price on the day of order. We may change our prices from time to time.
3.4 The prices we charge must be paid before we have an obligation to deliver.
3.5 Payment will be in accordance with our online service by credit card.
3.6 For special deliveries and payment (for example large, custom or retail orders) please contact us as steph@littlepotofgold.co.nz.
4. DELIVERY
4.1 Your Order will be delivered to the address you supplied.
4.2 We will not dispatch orders to addresses defined as “rural” by our courier company.
4.3 Your order will arrive in chilled, insulated packaging and with an ice pack.
4.4 Your order will be left at your address even if no one is available to accept it.
4.5 It is your responsibility to ensure your order is refrigerated as soon as possible following delivery.
4.6 Little Pot of Gold Limited takes no responsibility for the care of your order once it has been delivered.
5. SERVICE
5.1 If there is a delay with your order we will communicate this to you as soon as we are able. If we cannot deliver your order within 7 days of the initial delivery date we will offer you a full refund.
5.2 In the unlikely event that your order goes missing in the postal service, we will offer you a replacement as soon as possible or a refund, whichever you prefer.
6. QUALITY AND QUANTITY ASSURANCE
6.1 We have endeavoured to make the description of the available items as comprehensive as possible. If any item delivered is not as described at the time of selection we will rectify this.
6.2 If no arrangement can be agreed upon we will refund the unsatisfactory item.
6.3 All items are supplied weighing at least the advertised weight. In some cases items may be heavier than the advertised weight.
7. STORAGE & SHELF LIFE
7.1 Your baby food should be kept below 4°C in order to remain safe to eat.
7.2 All fresh products will be delivered to you with a minimum best before date of 10 days.
7.3 All frozen products will be delivered to you with a minimum best before date of six months. You should consume or freeze items prior to the date printed on each label.
7.4 Once fresh products have been opened, they should be kept refrigerated and consumed within 24 hours. Frozen products should be kept frozen until ready to use.
7.5 Uneven servings should be discarded and not reheated.
8. SAFETY & ALLERGENS
8.1 Defrost your baby food safely (either overnight in the fridge or by cooking thoroughly on the stovetop or in a microwave).
8.2 Always test the temperature of your baby food before feeding to a child.
8.3 If your products appeared damaged on arrival or the seal is broken, do not consume and contact Little Pot of Gold immediately at steph@littlepotofgold.co.nz for a replacement.
8.4 Always supervise your baby when they are eating. Small lumps may be a choking hazard.
8.5 While all due care is taken to ensure Little Pot of Gold products are not contaminated with allergens, our products are prepared on the same processing line as allergenic foods.
9. GUARANTEES
9.1 The Consumer Guarantees Act 1993 applies to this contract and accordingly:
(a) If any of the goods fail to comply with any guarantee in the Consumer Guarantees Act 1993, we will replace those goods;
(b) Without excluding our obligations under the Consumer Guarantees Act 1993, the Customer acknowledges that we do not provide any Express Guarantees (as defined in that Act);
9.2 There are otherwise no returns on goods or refunds where you have changed your mind once ordering or receiving your order.
9.3 You are responsible for the proper storage of your order.
9.4 You otherwise agree to purchase at your own risk. You agree that we are not liable for any direct or indirect loss or damage howsoever arising.
10. INTELLECTUAL PROPERTY
10.1 We own all copyright and other intellectual property in our products and trademarks. Everything on this website is copyright. We welcome the use of this site for personal use, non-commercial use, research or study – provided that the user acknowledges all copyright and other notices contained in the content.
